Livestreamer Awarded $2,800 in Portrait Rights Infringement Lawsuit

    Apr 09, 2020

A Shanghai court has ordered a cosmetic surgery clinic to pay 20,000 yuan ($2,800) in compensation to a celebrity livestreamer whose unauthorized photo it used in an advertisement, Sixth Tone’s sister publication The Paper reported Wednesday.

The Pudong New Area People’s Court said that the Hangzhou-based clinic had infringed the portrait rights of the plaintiff, Feng Timo. The livestreamer had sued the clinic for 1 million yuan in damages last year for using her photo, along with those of 30 other women, in a promotional poster displayed in the clinic.

Feng, one of China’s most famous livestreamers, had a lucrative partnership with the country’s Twitch-like streaming platform, Douyu, up until last year. She has more than 10 million followers on microblogging platform Weibo and more than 20 million subscribers on Douyu. (Image: VCG)
